กระแสสังคมรุมเร้าการทำงานของอัยการในคดีฟ้องขับไล่นายทุนออกจากที่ดิน ส.ป.ก.๔-๐๑ เมื่อศาลจังหวัดภูเก็ตพิพากษายกฟ้องโจทก์ แม้อดีตนายกรัฐมนตรี พ.ต.ท.ทักษิณ ชินวัตร ยังเอ่ยปากเชือดเฉือนอัยการผู้ทำคดีว่า”อัยการแกล้งแพ้”หรือเปล่า พวกเราก็ต้องขมขื่นกับข้อกล่าวหา ถูกสังคมบางส่วนตราหน้าว่าเพราะกระบวนการยุติธรรมเป็นเสียอย่างนี้สังคมจึงเลวปล่อยให้นายทุนฮุบที่ดินและแสวงหากำไรจากที่ดินของรัฐ
มีใครคิดจะขอโทษอัยการที่เคยดูแคลนบ้าง?
มีใครรู้บ้างไหมว่าอัยการที่ต้องไปสืบพยานคดี ส.ป.ก.เครียดในการทำคดีนี้อย่างไร ถูกแรงเบียดจากที่ใดบ้าง เขาสืบพยานกันอย่างไร เขาทำงานหนักกันขนาดไหน เอกสารมีมากน้อยขนาดไหน ทำไมเวลาแพ้คดีจึงมองอัยการในทางลบ เวลาอัยการชนะคดีไม่มีใครพูดถึง วันนี้ ศาลอุทธรณ์ภาค ๘ พิพากษา่ ให้คดีที่สำนักงานปฏิรูปที่ดินเพื่อเกษตรกรรม เป็นโจทก์ฟ้อง นายณรงค์…………..จำเลย ซึ่งมีนายบัณฑูร ทองตัน เป็นอัยการผู้รับผิดชอบสำนวน เป็นฝ่ายชนะคดี จะมีใครสงสัยบ้างไหมว่า ศาลแกล้งให้อัยการชนะ หรือจำเลยแกล้งแพ้บ้างไหม มีใครคิดจะขอโทษอัยการที่เคยดูถูกดูแคลนบ้างไหม
แน่นอนครับ คดีนี้ยังไม่ถึงที่สุดก็คงต้องว่ากันไปถึงศาลฎีกา แต่อย่างน้อยอัยการได้พิสูจน์อะไรบางสิ่งบางอย่างให้สังคมรับรู้ว่าู้ ศาลอุทธรณ์ก็เห็นด้วยกับที่อัยการที่ฟ้องคดีและนำพยานหลักฐานมาสืบให้เห็นชัด ถ้าอัยการทำงานกันชุ่ยๆ ศาลอุทธรณ์ภาค ๘ ก็คงไม่พิพากษาให้ขับไล่จำเลยและบริวารหรอกครับ ผมขอย่อคำพิพากษาศาลอุทธรณ์ ภาค ๘ มาให้อ่านกันบางส่วน ดังนี้ครับ
คดีมีปัญหาที่ต้องวินิจฉัยตามอุทธรณ์ของโจทก์ประการแรกว่า โจทก์มีอำนาจนำที่ดินตามหนังสืออนุญาตให้เข้าทำประโยชน์ในเขตปฏิรูปที่ดิน(ส.ป.ก.๔-๐๑ ก.)เลขที่ ๑๕ อำเภอเมืองภูเก็ต จังหวัดภูเก็ตไปปฏิรูปที่ดินเพื่อเกษตรกรรมและมีอำนาจฟ้องขับไล่จำเลยหรือไม่ เห็นว่า เมื่อทางราชการประกาศให้ที่พิพาทซึ่งนายเจริญครอบครองอยู่เป็นที่ดินในเขตป่าสงวนแห่งชาติ แม้คณะอนุกรรมการสำหรับป่าสงวนแห่งชาติป่าเทือกเขานาคเกิดตรวจสอบแล้วมีความเห็นว่าควรเพิกถอนป่าสงวนแห่งชาติหรือให้นายเจริญเช่าทำประโยชน์ต่อไป แต่ก็มิได้มีการดำเนินการตามความเห็นดังกล่าว
ดังนั้นที่ดินพิพาทจึงยังคงเป็นที่ดินที่อยู่ในเขตป่าสงวนแห่งชาติ การที่นายเจริญครอบครองทำประโยชน์ในที่ดินพิพาทเป็นเพียงแสดงว่าเฉพาะ ตัวนายเจริญผู้ขายสิทธิครอบครองให้แก่จำเลยขาดเจตนาที่จะบุกรุกที่ดินพิพาทซึ่งเป็นป่าสงวนแห่งชาติหรือไม่มีความผิดตามพระราชบัญญัติป่าสงวนแห่งชาติเท่านั้น เมื่อจำเลยซื้อสิทธิครอบครองที่ดินพิพาทจากนายเจริญ จำเลยผู้รับโอนสิทธิครอบครองจะอ้างสิทธิครอบครองที่ได้รับโอนมาใช้ยันได้ก็แต่เพียงราษฎรด้วยกันเอง การเข้ายึดถือครอบครองของจำเลยย่อมไม่ชอบด้วยกฎหมาย จำเลยไม่อาจยกสิทธิใดๆขึ้นโต้แย้งรัฐได้ เมื่อมีพระราชกฤษฎีกากำหนดให้ที่ดินในเขตป่าสงวนแห่งชาติดังกล่าวรวมถึงที่ดินพิพาทเป็นเขตปฏิรูปที่ดิน โจทก์จึงมีอำนาจนำที่ดินพิพาทไปปฏิรูปที่ดินได้ ตามมาตรา ๒๖(๔)ของพระราชบัญญัติการปฏิรูปที่ดินเพื่อเกษตรกรรม พ.ศ.๒๕๑๘ หากจำเลยมีคุณสมบัติครบถ้วนตามระเบียบคณะกรรมการปฏิรูปที่ดินเพื่อเกษตรกรรมว่าด้วยหลักเกณฑ์ วิธีการ เงื่อนไขในการคัดเลือกเกษตรกรซึ่งจะมีสิทธิได้รับที่ดินจากการปฏิรูปที่ดินเพื่อเกษตรกรรม พ.ศ.๒๕๓๕ แล้ว จำเลยอาจได้สิทธิเข้าทำประโยชน์ในเขตปฏิรุปที่ดิน เมื่อมีผู้ร้องเรียนว่า ผู้ได้รับสทธิเข้าทำประโยชน์ในเขตปฏิรูปที่ดิน แต่เมื่อมีผู้ร้องเรียนว่า ผู้ได้รับสิทธิเข้าทำประโยชน์ในเขตปฏิรูปที่ดินจังหวัดภูเก็ตบางราย ขาดคุณสมบัติการเป็นเกษตรกร และโจทก์สอบสวนแล้วได้ความว่า จำเลยซึ่งได้รับหนังสืออนุญาตให้เข้าทำประโยชน์ในเขตปฏิรูปที่ดิน(ส.ป.ก.๔-๐๑ ก.) ขาดคุณสมบัติในขณะยื่นแบบสอบสวนสิทธิขอเข้าทำประโยชน์ในที่ดินพิพาท
โจทก์จึงมีสิทธิเพิกถอนหนังสืออนุญาตให้เข้าทำประโยชน์ในเขตปฏิรูปที่ดิน(ส.ป.ก.๔-๐๑ ก.)ของจำเลยได้ และแม้ตามพระราชบัญญัติการปฏิรูปที่ดินเพื่อเกษตรกรรม พ.ศ.๒๕๑๘ จะมิได้ให้อำนาจแก่โจทก์โดยตรงที่จะขับไล่จำเลยและบริวารออกจากที่ดินโจทก์ ผู้มีสิทธินำที่ดินไปปฏิรูปที่ดินเพื่อเกษตรกรรมตามกฎหมายย่อมมีอำนาจฟ้องขับไล่จำเลยและบริวารได้
คดีมีปัญหาที่ต้องวินิจฉัยต่อไปว่า จำเลยเป็นเกษตรกรซึ่งมีสิทธิเข้าทำประโยชน์ที่ดินในเขตปฏิรูปที่ดินเพื่อเกษตรกรรมหรือไม่ ปัญหาข้อนี้ศาลชั้นต้นชี้สองสถานแล้วมิได้หยิบยกขึ้นวินิจฉัย แต่เมื่อมีข้อเท็จจริงตามพยานหลักฐานในสำนวนที่โจทก์และจำเลยนำสืบมาทั้งหมดเพียงพอวินิจฉัยได้แล้ว ศาลอุทธรณ์ภาค ๘ เห็นสมควรวินิจฉัยโดยไม่ต้องย้อนสำนวนไปให้ศาลชั้นต้นวินิจฉัย
เห็นว่า พระราชบัญญัติการปฏิรูปที่ดินเพื่อเกษตรกรรม พ.ศ.๒๕๑๘ มาตรา ๔ ให้บทนิยามของการปฏิรูปที่ดินเพื่อเกษตรกรรมว่า เป็นการจัดที่ดินให้แก่เกษตรกรผู้ไม่มีที่ดินของตนเองหรือเกษตรกรที่มีที่ดินเล็กน้อยไม่เพียงพอแก่การครองชีพ และให้บทนิยามของ “เกษตรกร” ว่า ผู้ประกอบอาชีพเกษตรกรรมเป็นหลัก และให้หมายความรวมถึงบุคคลผู้ยากจนหรือผู้จบการศึกษาทางเกษตรกรรมหรือผู้เป็นบุตรของเกษตรกรบรรดาซึ่งไม่มีที่ดินเพื่อเกษตรกรรมของตนเองและประสงค์จะประกอบอาชีพเกษรกรรมเป็นหลัก ตามหลักเกณฑ์และเงื่อนไขที่กำหนดในพระราชกฤษฎีกาด้วย
จากบทนิยามดังกล่าวจะเห็นได้ว่าเจตนารมณ์ของการปฏิรูปที่ดินเพื่อเกษตรกรรมเป็นการจัดที่ดินให้แก่เกษตรกรที่ไม่มีที่ดินของตนเองหรือมีที่ดินเล็กน้อยไม่เพียงพอแก่การครองชีพ และคำว่า “เกษตรกร” นั้นบทนิยามตามมาตรา ๔ ได้แบ่งเกษตรกรออกเป็น ๒ ประเภท คือ ประเภทที่ ๑ ผู้ประกอบอาชีพเกษตรกรรมเป็นหลัก และประเภทที่ ๒ บุคคลผู้ยากจนหรือผู้จบการศึกษาทางเกษตรกรรมหรือผู้เป็นบุตรของเกษตรกร โดยบุคคลทั้งสองประเภทดังกล่าวต้องไม่มีที่ดินเพื่อเกษตรกรรมของตนเอง และประสงค์จะประกอบอาชีพเกษตรกรรมเป็นหลัก และนอกจากนี้ผู้ที่จะได้รับหนังสืออนุญาตให้เข้าทำประโยชน์ในเขตปฏิรูปที่ดิน (ส.ป.ก.๔-๐๑ ก.)ต้องมีคุณสมบัติตามระเบียบคณะกรรมการปฏิรูปที่ดินเพื่อเกษตรกรรมว่าด้วยหลักเกณฑ์ วิธีการ และเงื่อนไขในการคัดเลือกเกษตรกรซึ่งจะมีสิทธิได้รับที่ดินจากการปฏิรูปเพื่อเกษตรกรรม พ.ศ.๒๕๓๕
ซึ่งระเบียบดังกล่าวข้อ ๔.มีข้อความว่า ในระเบียบนี้ “เกษตรกร”หมายความว่า (๑) ผู้ประกอบอาชีพเกษตรกรรมเป็นหลัก โดยพิจารณาจากการใช้เวลาส่วนใหญ่ในรอบปีเพื่อประกอบเกษตรกรรมแห่งท้องถิ่นนั้น (๒) ผู้ยากจน ผู้จบการศึกษาทางเกษตรกรรม และผู้เป็นบุตรของเกษตรกรที่กำหนดในพระาชกฤษฎีกา และข้อ ๖.มีข้อความว่า เกษตรกรผู้ซึ่งมีคุณสมบัติดังต่อไปนี้ มีสิทธยื่นคำร้องขอเข้าทำประโยชน์ในที่ดินในเขตปฏิรูปที่ดินตามข้อ ๕ ได้…..(๖) ไม่มีที่ดินเพื่อประกอบเกษตรกรรมเป็นของตนเองหรือของบุคคลในครอบครัวเดียวกันหรือมีที่ดินเพียงเล็กน้อย แต่ไม่เพียงพอแก่การประกอบเกษตรกรรมเพื่อเลี้ยงชีพ
เมื่อข้อเท็จจริงได้ความว่า ขณะมีพระราชกฤษฎีกากำหนดเขตที่ดิน ในท้องที่ตำบลเชิงทะเล ตำบลศรีสุนทร อำเภอถลาง ตำบลกมลา ตำบลกะทู้ ตำบลป่าตอง อำเภอกะทู้ และตำบลเกาะแก้ว ตำบลรัษฎา ตำบลวิชิต ตำบลกะรน ตำบลฉลอง ตำบลราไวย์ อำเภอเมืองภูเก็ต จังหวัดภูเก็ต ซึ่งรวมถึงที่ดินพิพาทให้เป็นเขตปฏิรูปที่ดิน พ.ศ.๒๕๓๗ จำเลยเป็นกรรมการผู้มีอำนาจจัดการของบริษัทรวม ๔ บริษัท เป็นหุ้นส่วนในบริษัทอีก ๑ บริษัท และห้างหุ้นส่วน ๑ ห้าง มีเงินลงทุนเฉพาะส่วนของจำเลย ๔๕,๐๐๐,๐๐๐ บาท นอกจากนี้ จำเลยและบุคคลในครอบครัวมีที่ดินในเขตจังหวัดภูเก็ตและจังหวัดพังงาประมาณ ๘๐๐ ไร่ ดังนั้น ศาลอุทธรณ์ภาค ๘ โดยมติที่ประชุมใหญ่เห็นว่าจำเลยจึงไม่ได้เ็ป็นเกษตรกรผู้ประกอบอาชีพเกษตรกรรมเป็นหลักและไม่มีคุณสมบัติตามข้อ ๖(๖) ของระเบียบคณะกรรมการปฏิรูปที่ดินเพื่อเกษตรกรรมฯ ดังกล่าวด้วย เมื่อจำเลยขาดคุณสมบัติในการยื่นคำร้องขอเข้าทำประโยชน์ในเขตปฏิรูปที่ดิน การที่คณะกรรมการปฏิรูปที่ดินเพื่อเกษตรกรรมเห็นว่าจำเลยขาดคุณสมบัติดังกล่าว มีคำสั่งให้เพิกถอนหนังสืออนุญาตให้เข้าประโยชน์ในที่ดินพิพาทจึงเป็นการชอบแล้ว ซึ่งโจทก์ได้มีหนังสือแจ้งให้จำเลยทราบ จำเลยและบริวารจึงต้องออกจากที่ดินพิพาทที่ศาลชั้นต้นพิพากษายกฟ้องโจทก์นั้น ศาลอุทธรณ์ภาค ๘ ไม่เห็นพ้องด้วย อุทธรณ์ของโจทก์ฟังขึ้น
พิพากษากลับ ให้จำเลยและบริวารออกจากที่ดินพิพาท ค่าฤชาธรรมเนียมชั้นอุทธรณ์เป็นพับ
ผมนำเสนอบทความชิ้นนี้ มิได้มีเจตนาให้คนพูดมากราบขอโทษผมหรอกครับ แต่ผมเขียนเพื่อเป็นอุทธาหรณ์แก่บุคคลทั่วไปว่า ก่อนจะตัดสินใจด่าว่าใครว่าเขาเลว เขาชั่ว ขอให้ฟังความให้ครบถ้วนก่อน อย่าด่วนตัดสินว่าเขาผิด โดยเฉพาะอย่างยิ่งคนที่เป็นอัยการที่ยึดมั่นในคุณธรรมจริยธรรมที่ดีมีเยอะครับ ที่ออกนอกลู่นอกทางก็มีบ้าง แต่คณะกรรมการอัยการเขาเข้มแข็งครับ ไล่ออกหรือให้ออกก็มีให้เห็นแล้ว อัยการก็เป็นคนธรรมดาที่มีความคิดอ่าน มีกิเลสตัณหา ถ้าทำความดีแล้วถูกตำหนิติเตียน ส่วนคนทำความชั่วมีเงินมีทองใช้อย่างสบาย จิตเขาก็อาจตกอยากคิดทำชั่วบ้างเพื่อความสบายของตัวเองมีเงินมีทองใช้อย่างสุร่ยสุร่าย แต่ถ้าจิตใจเขาเข้มแข็งเขาก็ยืนหยัดในสิ่งที่เขากระทำต่อไป แม้คนไม่เห็นเทวดาก็เห็น คนอื่นไม่เห็นตัวเราเห็นแล้วเก็บความภาคภูมิใจในสิ่งที่เห็นไว้กับตัวเพื่อเป็นพลังกับตัวเองต่อไป กรุณาให้กำลังใจให้คนทำความดีกันเถอะครับ และอย่าวิพากย์วิจารณ์ใครก่อนตรวจสอบข้อเท็จจริง
รู้ไหม ตอนที่ศาลยกฟ้อง หนังสือพิมพ์แต่ละฉบับลงข่าวกันครึกโครม ประชาชาติธุรกิจทำสกู๊ปข่าวเรื่องนี้โดยเฉพาะ ทำไมอัยการไม่สืบอย่างโน้น ไม่บรรยายฟ้องอย่างนี้ ผมอ่านแล้วยังรู้สึกว่า เออ…ตูทำชั่วกับเขาเป็นด้วยหรือ….อิอิ แต่พอศาลอุทธรณ์ยกฟ้องทำไมหนังสือพิมพ์ที่วิพากย์วิจารณ์การทำงานของอัยการไม่พาดหัวบ้างละครับว่า “ศาลอุทธรณ์ให้อัยการชนะคดี ส.ปก.ที่ภูเก็ต”
หรือว่าข่าวมันไม่น่าสนใจ……

วันก่อนดูทีวีก็เห็นข่าวเรื่องการบุกรุก ที่รีสอร์ทไปสร้างเสียใหญ่โตและศาลมีคำสั่งให้ถอดถอนสิ่งก่อสร้างออก ชื่นใจครับที่เป็นปรากฏผลออกมาเช่นนี้…
เห็นด้วยกับพี่บางทรายค่ะว่าชื่นใจที่ผลเป็นแบบนี้ และภูมิใจที่ไทยมีอัยการ ..ทนายของแผ่นดินที่ยอดเยี่ยมค่ะ
